Terms

These are the terms of Demurrage Recheck. Asking for a re-check commits you to nothing; they apply once you accept them in your account, before you send a voyage.

  1. What we do. Demurrage Recheck re-calculates laytime and demurrage for closed voyages you hand over: from the charter party (or recap) and the statements of facts you upload, and the figures you give us. Code reads the documents and does the arithmetic; a laytime reviewer working for us checks every term against the charter party and every time against the statement of facts before you see anything. You receive the statement on screen and a claim letter as a Word file.
  2. What we do not do. We do not send the claim, negotiate it or contact your counterparty: you decide whether to claim and you send it. We do not act in arbitration or in court and we give no legal advice. We do not judge whether a notice of readiness was valid or how a disputed clause is to be read: where the charter party is unclear, the reviewer tells you, and you decide. No one can promise that a claim is paid.
  3. Your part. You give us true and complete documents for voyages you are entitled to claim on, read the statement before you use it, and send the claim yourself with every document the charter party's claims clause requires. You remain responsible for the time bar: we show the deadline computed from the clause as entered, but the charter party's own words decide.
  4. Fee. Re-calculating your closed voyages is free. If the claim we prepare is paid, our fee is 15% of what the charterers pay on it, invoiced after the money arrives. Nothing recovered, nothing to pay. The fee is 15% of the amount the charterers pay on a claim we prepared, whether paid in full or in a settlement, and is due within 14 days of our invoice. If the re-calculation finds nothing under-paid, or you decide not to claim, nothing is due. No VAT statement is made here until our VAT position is settled.
  5. Your data. Documents you upload and the text read from them are deleted 30 days after upload. The published re-calculation stays until you delete your account, which you can do at any time in settings. We never use your documents to train any model.
  6. Ending it. You can stop at any time. A fee already earned on money already paid to you stays due.
